1. Acceptance of Terms & Platform Scope

Welcome to Monsoon Malabar (“Platform”, “we”, “us”, or “our”). By accessing our website, creating an account, signing in with Google OAuth, or using any of our merchant and storefront services, you agree to be bound by these Terms of Service.

Monsoon Malabar provides multi-tenant software-as-a-service (SaaS) and e-commerce infrastructure enabling independent merchants to create, manage, and operate digital storefronts, product catalogs, and order management tools.

2. Operational Independence & Responsibility of Content

Merchant Sole Responsibility: Each store hosted on this platform is independently owned and operated by its respective merchant. Responsibility of Content & Operations (including all financial transactions, pricing, order fulfillment, shipping and handling, courier logistics, returns, refunds, customer service, and regulatory compliance) rests exclusively with the individual store owner.

Monsoon Malabar is a software and technology provider only. We are not a broker, auctioneer, retailer, or party to any transaction between buyers and merchants.

3. “As Is” Content & Warranty Disclaimer

All software tools, merchant features, storefront APIs, catalog content, product listings, images, and descriptions are provided strictly on an “as is” and “as available” basis without warranties of any kind, whether express, statutory, or implied.

Monsoon Malabar and its infrastructure partners expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, uptime, and data accuracy. We do not warrant that platform operations will be uninterrupted, error-free, or entirely secure.

4. Account Eligibility & Google Authentication

Store owners authenticate securely via Google OAuth (OpenID Connect). You are responsible for safeguarding your Google account credentials and for all activities that occur under your stores.

Each user account may operate up to the current platform limit of stores (currently up to 10 active shops per account). Each store under an account must represent a distinct business category.

5. Acceptable Use & Prohibited Content

Merchants and users agree not to use the platform for any unlawful, deceptive, or abusive purposes, including:

• Listing counterfeit products, stolen goods, prohibited drugs, weapons, or items infringing upon intellectual property or trademark rights.
• Submitting fraudulent orders, abusive communications, spam, or misleading promotional claims.
• Deploying automated scraping bots, crawlers, or attempting to reverse-engineer, exploit, or bypass platform write quotas and rate limits.
• Uploading malicious files, web shells, or scripts disguised as images or media.

Violations of these standards will result in immediate suspension or termination of store access without notice.

6. Safe Commerce & Financial Disclaimers

Monsoon Malabar does not collect customer payments for merchant merchandise. All payments, shipping charges, and handling fees are agreed upon and handled directly between buyers and merchants.

We strongly advocate for and support Cash on Delivery (COD), One-Time Password (OTP) verification upon delivery, and Open Box Delivery (OBD) to minimize fraud risks for both buyers and merchants.

7. Hosting & Infrastructure Providers

Monsoon Malabar's databases and application servers are securely hosted with Microsoft Azure. Content delivery, edge caching, DDoS mitigation, and SSL certification are powered by Cloudflare.

8. Limitation of Liability

To the fullest extent permitted by applicable law, neither Monsoon Malabar, Microsoft Azure, Cloudflare, nor their founders, officers, employees, or agents shall be liable for any indirect, punitive, special, incidental, or consequential damages (including loss of profits, revenue, data, or business goodwill) arising from the use of, or inability to use, the platform or any goods sold by merchants.

9. Modifications & Governing Law

We reserve the right to modify these Terms of Service at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.

1. Scope & Privacy Commitment

Monsoon Malabar (“Platform”, “we”, “us”) is committed to protecting the privacy of store owners, merchants, and platform visitors. This Privacy Policy details how we collect, store, and process personal and business information across the platform.

2. Information We Collect

• Google OAuth Authentication: When you sign in as a store owner, we receive your verified Google Account identifier (sub), name, verified email address, and profile picture via OpenID Connect. We never receive or store your Google password, nor do we request access to your private Google Drive or personal files.
• Store & Catalog Information: Store names, categories, contact phone numbers, language preferences, physical shop location coordinates (lat/long for regional store discovery), product details, pricing, and uploaded media URLs.
• Technical & Telemetry Data: Standard connection headers (IP address, user agent, requested URLs) processed automatically by our CDN and DDoS mitigation layer (Cloudflare) to maintain service security and prevent abuse.

3. How Information Is Used

We use the collected information exclusively to:

• Authenticate store owners and provide access to the merchant administration dashboard.
• Render and deliver public storefront catalogs and marketplace discovery listings.
• Enforce rate limits, write quotas, and security controls to protect platform integrity.
• Deliver critical operational notices regarding your stores.

We do not sell, rent, or trade your personal or business data to third-party data brokers or marketing agencies.

4. Cloud Hosting & Data Security

• Microsoft Azure: Platform databases and backend services are securely hosted within Microsoft Azure enterprise cloud environments.
• Cloudflare & Turnstile: Edge routing, SSL/TLS certificates, and bot prevention are managed via Cloudflare. Cloudflare Turnstile validates human interactions on forms without harvesting cross-site tracking history or relying on invasive third-party ad cookies.
• Session Security: Admin sessions use secure, encrypted HTTP-only session cookies. In accordance with security standards, the administration service worker intentionally avoids caching authenticated admin pages in browser Cache Storage to prevent data leakage on shared devices.

5. Data Ownership & Merchant Control

Store owners retain full ownership of their catalog content, products, and posts. You may edit, update, or permanently delete products, posts, and locations at any time directly through the merchant dashboard.

6. Your Privacy Rights

You have the right to request access to the personal data we hold about you, request corrections, or request account deletion. To submit a data inquiry or request account removal, please contact platform support at [email protected].

We may update this Privacy Policy from time to time. Any changes will be posted directly within this modal with an updated revision date.
